OVERVIEW

This website and the KAVALE brand are operated by Kaiping Nomona Plumbing Technology Development Co., Ltd..

Throughout these Terms of Service, “KAVALE,” “we,” “us,” and “our” refer to Kaiping Nomona Plumbing Technology Development Co., Ltd.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer and sell our products. Shopify is not the seller of KAVALE products and is not responsible for fulfilling customer orders.

By visiting our website, creating an account, or purchasing a product, you agree to these Terms of Service, our Return and Refund Policy, Shipping Policy, Privacy Policy, and any other policies displayed on our website.

If you do not agree to these terms, you should not use this website or place an order.

1. ELIGIBILITY

You must be at least the age of majority in your state or place of residence to place an order.

You agree to provide current, complete, and accurate billing, payment, contact, and shipping information.

You are responsible for maintaining the confidentiality of your account information and for all activities conducted through your account.

2. PRODUCTS

We make reasonable efforts to describe and display our products accurately. However, colors and finishes may appear different depending on screen settings, lighting conditions, surrounding materials, and natural variations in metal and handcrafted finishes.

Minor variations in color, texture, patina, dimensions, or finish that are normal characteristics of metal, handcrafted, or made-to-order products are not considered defects.

Product images are provided for reference. Please review the product description, dimensions, installation requirements, finish selection, and technical specifications before ordering.

We may modify or discontinue products, finishes, specifications, prices, or availability at any time. Changes do not affect orders that we have already accepted unless the customer agrees to the change.

3. MADE-TO-ORDER PRODUCTS

KAVALE faucets are made to order.

Production normally takes approximately 4–12 weeks after payment and confirmation of all specifications.

Production time is separate from shipping time.

Customers are responsible for reviewing and confirming all selected specifications, including model, finish, dimensions, installation type, and quantity.

Requests to change an order must be submitted within 24 hours after the order is placed. Changes requested after production begins cannot be guaranteed and may result in additional charges or delays.

4. ORDERS AND ORDER ACCEPTANCE

Submitting an order does not guarantee that we will accept or fulfill it.

After receiving an order, we may review payment information, shipping eligibility, product specifications, availability, pricing, and suspected fraud.

We reserve the right to refuse or cancel an order for legitimate reasons, including:

• Incorrect product or pricing information
• Payment authorization problems
• Suspected fraud or unauthorized payment
• Product unavailability
• Incomplete specifications
• An unsupported shipping address
• Legal or regulatory restrictions
• An obvious website or system error

If we cancel an order before shipment, we will refund the applicable amount to the original payment method.

If an unsupported shipping address is provided, we will contact the customer to request an eligible address. If an eligible address cannot be provided within 3 business days, the order will be canceled and fully refunded, including the shipping charge.

5. ORDER CANCELLATIONS

Customers may request a full cancellation within 24 hours after placing an order by contacting info@kavaledesign.com.

After the 24-hour cancellation period, production may already have started. Cancellation or changes after this period cannot be guaranteed.

If we approve a cancellation after production has started, reasonable production costs may be deducted. We will inform the customer of any proposed deduction before completing the cancellation.

6. PRICES AND PAYMENT

Unless otherwise stated, all prices are displayed in United States dollars.

Shipping charges are calculated and displayed separately at checkout.

Applicable state or local sales tax may be calculated separately at checkout where legally required.

For orders shipped to the 48 contiguous United States and Washington, DC, applicable import duties and standard customs clearance charges are included in the product price and paid by KAVALE.

Customers will not normally be required to pay additional import duties upon delivery.

Charges caused by incorrect customer information, refusal of delivery, storage, redelivery, address correction, or other circumstances attributable to the customer are not included.

You represent that you are authorized to use the payment method submitted with your order.

7. SHIPPING AND DELIVERY

We currently ship only to eligible physical street addresses within the 48 contiguous United States and Washington, DC.

We do not currently ship to Alaska, Hawaii, Puerto Rico, U.S. territories, APO/FPO/DPO addresses, P.O. Boxes, or parcel lockers.

Production and delivery times are estimates based on information reasonably available when the order is placed.

If we learn that we cannot ship within the stated production timeframe, we will notify the customer and provide a revised estimated shipment date. The customer may agree to the delay or cancel the unshipped order for a full refund.

Delivery may be affected by customs inspections, port congestion, vessel schedules, carrier delays, weather, public holidays, incorrect addresses, or other circumstances outside our reasonable control.

8. RETURNS AND REFUNDS

Eligible return requests must be submitted within 30 days after delivery.

Products must be unused, uninstalled, complete, undamaged, and returned in their original condition and packaging.

For an eligible voluntary return:

• The customer is responsible for return shipping.
• The original shipping charge is non-refundable.
• A 15% restocking fee will be deducted from the product refund.
• Prior return authorization is required.

Special custom products manufactured outside our standard website options may be final sale.

Products that are damaged during shipping, defective, incomplete, or different from the product ordered will be handled according to our Return and Refund Policy.

Nothing in these Terms limits rights that cannot legally be excluded under applicable consumer protection laws.

9. INSTALLATION AND PRODUCT USE

Faucets and plumbing products should be installed by a qualified or appropriately licensed plumbing professional.

Customers and installers are responsible for confirming that the product is suitable for the installation location and compatible with local plumbing connections, water pressure, building requirements, and applicable codes.

Products should be inspected before installation. Do not install a product that appears damaged, incomplete, incorrect, or defective. Contact us first at info@kavaledesign.com.

KAVALE is not responsible for damage caused by improper installation, unauthorized modification, misuse, excessive water pressure, unsuitable cleaning products, failure to follow instructions, or work performed by a third-party installer.

This section does not exclude responsibility for a manufacturing defect or any liability that cannot legally be excluded.

10. WEBSITE INFORMATION

We make reasonable efforts to ensure that information on our website is accurate and current. However, typographical errors, inaccuracies, or omissions may occasionally occur.

We may correct errors and update information at any time. If an error materially affects an order that has already been placed, we will contact the customer before proceeding or provide the option to cancel for a full refund.

Information on this website is provided for general product information and does not replace professional plumbing, engineering, architectural, legal, or regulatory advice.

11. INTELLECTUAL PROPERTY

All website content, including trademarks, logos, product names, photographs, graphics, videos, text, designs, layouts, and other materials, is owned by or licensed to KAVALE unless otherwise stated.

You may use the website only for personal, non-commercial shopping purposes.

You may not reproduce, distribute, modify, publish, sell, commercially exploit, scrape, or create derivative works from our website content without prior written permission.

12. PROHIBITED USES

You may not use this website:

• For unlawful or fraudulent purposes
• To violate intellectual property rights
• To submit false or misleading information
• To transmit malicious code or interfere with website security
• To collect personal information about other users without authorization
• To attempt unauthorized access to our systems or accounts
• To place orders using an unauthorized payment method
• To interfere with the operation of the website or Shopify platform

We may restrict or terminate access when we reasonably believe these Terms have been violated.

Our website may contain links to third-party websites or use services provided by Shopify, payment processors, shipping carriers, analytics providers, and other service providers.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control, except where applicable law provides otherwise.

By placing an order, you authorize us and our service providers to use the information reasonably necessary to process payment, manufacture the product, deliver the order, provide customer service, prevent fraud, and comply with legal obligations.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law, KAVALE will not be liable for indirect, incidental, special, or consequential losses arising from the use of this website or products.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, defective products where liability cannot be excluded, or any mandatory consumer rights.

16. EVENTS OUTSIDE OUR CONTROL

We are not responsible for failure or delay caused by circumstances beyond our reasonable control, including natural disasters, severe weather, epidemics, government actions, customs inspections, port closures, labor disputes, transportation disruptions, carrier failures, war, civil unrest, or interruption of utilities or communication systems.

If such an event materially delays an unshipped order, we will notify the customer and provide available options, which may include agreeing to a revised shipment date or canceling for a full refund.

17. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles, except where mandatory consumer protection laws in the customer’s place of residence apply.

Before beginning formal legal proceedings, customers are encouraged to contact us at info@kavaledesign.com so that we can attempt to resolve the matter.

Any dispute that cannot be resolved informally will be submitted to a court with lawful jurisdiction, subject to any mandatory rights the customer may have under applicable law.

18. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

19. NO WAIVER

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

20. CHANGES TO THESE TERMS

We may update these Terms from time to time by publishing a revised version on this website.

Changes apply to future website use and future orders. Changes do not retroactively alter the terms applicable to orders already accepted unless required by law or agreed with the customer.
